Privacy Policy for Website Users

This Website Privacy Policy (“Policy”) describes how Silicon Valley Mechanical, Inc. (“SVM,” “Company,” “we,” or “us”) collects and processes personal information about users of our website. The California Consumer Privacy Act ("CCPA") requires us to provide our California consumers with a privacy policy that contains a comprehensive description of our online and offline practices regarding our collection, use, sale, sharing, and retention of their personal information, along with a description of the rights consumers have regarding their personal information. This Privacy Policy provides the information the CCPA requires, together with other useful information regarding our collection and use of personal information. Any terms defined in the CCPA have the same meaning when used in this Policy.

This Policy applies to personal information we collect and use with respect to website users. 

Personal Information Collected

We collect and use information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household ("personal information"). We and our third-party partners collect Personal Information through cookies, pixels, SDKs, tags, and other tracking technologies placed on our Services. These third-party technologies may collect the following categories of Personal Information from your device and browser over time and across different websites and online services. We collect this information at or before the point of collection through these technologies for the purposes described below, and we provide notice at collection via this Privacy Policy and, where applicable, just-in-time notices.

Personal information does not include:

1. Publicly available information, including from government records, through widely distributed media, or that the consumer made publicly available without restricting it to a specific audience.

2. Lawfully obtained, truthful information that is a matter of public concern.

3. Deidentified or aggregated consumer information.

4. Information excluded from the CCPA's scope, including:

   1. health or medical information covered by the Health Insurance Portability and Accountability Act (HIPAA) and the California Confidentiality of Medical Information Act (CMIA), clinical trial data, or other qualifying research data; or

   2. personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA), California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act.

We obtain the categories of personal information listed above from the following categories of sources:

• Your use of our website, https://www.svminc.com/, or any website of ours that links to this privacy policy. More specifically, third party cookies collect the data identified above, and you may provide us with data when you submit a query to us on the “Get in Touch” section of the Contact Us page. 

Purposes for Collection and Use

We may use and disclose the personal information, including sensitive personal information, we collect to advance the Company's business and commercial purposes, specifically to:

1. Respond to your query on the Get in Touch page. Once you voluntarily provide the information to us, we reserve all rights to use the information for any reasonable business or commercial purpose. 

2. Administer, maintain and secure technological and physical systems, facilities, operations, assets, and personnel; prevent unauthorized access; detect and investigate security incidents; and ensure workplace safety. To administer our systems and conduct internal operations, including for troubleshooting, data analysis, testing, research, statistical, and survey purposes. 

3. Providing, maintaining, securing, debugging, and improving the Services; measuring and analyzing traffic, usage, and performance; fraud prevention; short-term, transient use, such as contextual ad customization; internal research and development; and advertising and marketing, including cross-context behavioral advertising (also referred to as targeted advertising or “sharing” under California law), ad delivery and reporting, frequency capping, and measuring ad effectiveness.

4. Protect our Company, employees, or operations, and to exercise or defend the legal rights of the Company and its employees, customers and vendors. To comply with our contracts, as well as all federal, state, and local laws.  

5. Fulfill the purposes for which you provided your personal information or that were described to you at collection, and as the CCPA otherwise permits.

6. Respond to law enforcement requests and as required by applicable law or court order.

Sensitive Personal Information

Sensitive Personal Information Use and Disclosure Purposes

We do not collect sensitive personal information (SPI) to infer characteristics about a person. Nonetheless, we reserve the right to use SPI for the following statutorily approved reasons (Permitted SPI Purposes):

• Performing actions that are necessary for our relationship with you and that an website user would reasonably expect.

• Preventing, detecting, and investigating security incidents that compromise the availability, authenticity, integrity, or confidentiality of stored or transmitted personal information. 

• Defending against and prosecuting those responsible for malicious, deceptive, fraudulent, or illegal actions directed at the Company.

• Ensuring physical safety.

• Short-term, transient use, such as non-personalized advertising shown as part of your current interactions with us, where we do not:

  • disclose the sensitive personal information to another third party; or

  • use it to build a profile about you or otherwise alter your experience outside your current interaction with the Company.

• Services performed for the Company, including maintaining or servicing accounts, processing or fulfilling transactions, verifying consumer information, processing payments, or providing financing, analytic services, storage, or similar services for the Company.

• Activities required to:

  • verify or maintain the quality or safety of a product, service, or device that we own, manufacture, had manufactured, or control; or

  • improve, upgrade, or enhance the service or device that we own, manufacture, had manufactured, or controlled.

• Collecting or processing sensitive personal information that we do not use for the purpose of inferring characteristics about a consumer.  

We will not use sensitive personal information for purposes other than the Permitted SPI Purposes.  We do not use SPI for each or every purpose listed above. 

Additional Categories or Other Purposes

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice. If required by law, we will also seek your consent before using your personal information for a new or unrelated purpose.

We may collect, process, and disclose aggregated or deidentified consumer information for any purpose, without restriction. When we collect, process, or disclose aggregated or deidentified consumer information, we will maintain and use it in deidentified form and will not attempt to reidentify the information, except to determine whether our deidentification processes satisfies any applicable legal requirements.

Disclosing, Selling or Sharing Personal Information

Some disclosures of Personal Information collected via third-party cookies and similar technologies may be considered a “sale” or “sharing” of Personal Information under California law. This may include allowing third-party advertising and analytics partners to collect Personal Information across our Services and nonaffiliated websites or apps to help deliver ads tailored to your interests, measure performance, and improve relevance. The categories of Personal Information that may be sold or shared include: (a) identifiers; (b) internet or other electronic network activity information; (c) geolocation data (approximate); (d) commercial information; and (e) inferences. The categories of third parties to whom information may be sold or shared include advertising networks, demand-side or supply-side platforms, social networks, data analytics providers, and measurement providers.

We do not knowingly sell or share the Personal Information of consumers under 16 years of age. If we learn that we have done so, we will take appropriate steps to honor opt-out rights and remediate as required. Parents or guardians may contact us per below to request review or deletion.

How to Manage Cookies and Make Choices

You can control cookies and similar technologies by: (a) responding to our prompts, tools or banners to enable/disable categories of cookies; (b) adjusting your browser or device settings to block or delete cookies; and (c) submitting a “Do Not Sell or Share My Personal Information” request and/or enabling a GPC signal. Because some choices are browser- or device-specific, you may need to set preferences on each browser and device you use. Disabling certain cookies may impact site functionality.

Your Rights

Right to Know and Data Portability Requests

You have the right to request that we disclose certain information to you about our collection and use of your personal information (the "right to know"), including the specific pieces of personal information we have collected about you (a "data portability request"). You may exercise your right to know twice in any 12-month period. Once we receive your request and confirm your identity, we will disclose to you:

• The categories of:  

  • personal information we collected about you; and

  • sources from which we collected your personal information.

• The business or commercial purpose for collecting your personal information and, if applicable, selling or sharing your personal information.

• If applicable, the categories of persons, including third parties, to whom we disclosed your personal information, including separate disclosures identifying the categories of your personal information that we:

  • disclosed for a business purpose to each category of persons; and

  • sold or shared to each category of third parties.

• When your right to know submission includes a data portability request, a copy of your personal information, subject to any permitted redactions.

Right to Delete and Right to Correct

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions and limitations (the "right to delete"). Once we receive your request and confirm your identity, we will delete your personal information from our systems unless an exception allows us to retain it. We will also notify our service providers, contractors, and other recipients to take appropriate action.

You also have the right to request correction of personal information we maintain about you that you believe is inaccurate (the "right to correct"). We may require you to provide documentation, if needed, to confirm your identity and support your claim that the information is inaccurate. Unless an exception applies, we will correct personal information that our review determines is inaccurate and notify our service providers, contractors, and other recipients to take appropriate action. 

Right to Limit Sensitive Personal Information Use and Disclosure to Permitted SPI Purposes

You have a right to ask businesses that use or disclose your sensitive personal information to limit those actions to just the CCPA's Permitted SPI Purposes (the "right to limit"). As we do not use or disclose sensitive personal information beyond the CCPA's Permitted SPI Purposes, we do not currently provide this consumer right. 

Personal Information Sales or Sharing Opt-Out and Opt-In Rights

You have the right to request that businesses stop selling or sharing your personal information at any time (the "right to opt-out"), including through a user-enabled opt-out preference signal. Similarly, the CCPA prohibits businesses from selling or sharing the personal information of consumers it actually knows are under 16 years old without first obtaining consent from consumers who are between 13 and 15 years old or the consumer's parent or guardian for consumers under age 13 (the "right to opt-in"). You may exercise this right by using our “Do Not Sell or Share My Personal Information” link, which is available at the footer of our website and within app settings. We also honor opt-out preference signals, such as the Global Privacy Control (GPC), when received from your browser or device in a frictionless manner.

ADMT Rights

When a business uses automated decision-making technology (ADMT) to make significant decisions about you, you may have certain rights under the Act. We do not currently use ADMT to make significant decisions about consumers, so we do not provide ADMT access, opt-out, or appeal rights.

Right to Non-Discrimination

You have the right not to be discriminated or retaliated against for exercising any of your privacy rights under the CCPA.

Data Retention

We retain personal information and sensitive personal information for periods reasonably necessary and proportionate to achieve the purposes described in this policy, consistent with legal, regulatory, and operational requirements, and Company record retention schedules.  We have a separate document retention policy that describes our policy in more detail, available upon request. Typically, cookies within our custody or control are maintained for the duration of the session, up to a maximum of two years.  Marketing cookies are maintained by third party providers including Google AdSense and Bing Ads, and are subject to their retention policies.  Retention of queries to our Get in Touch feature depend on the nature of the query, but may be a retained for a maximum of ten years post substantial completion or longer if connected to a job file as required by law. 

Security

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect your data, recognizing that no system is completely secure.

Changes to this Policy

We may update this policy from time to time. Material changes will be communicated consistent with Company practices, and the Effective Date will be updated.

To exercise your rights described in this policy, submit a request to the below. Please describe your request with sufficient detail so we can properly understand, evaluate, and respond to it.  We will endeavor to respond to all requests within the statutory period, which is typically 45 days unless we request additional time. Our response will inform you whether we have complied with your request. If we cannot comply, our response will explain the reason(s) why. We reserve all rights under the Act, including but not limited to the manner and time periods for our responses provided therein.
